TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legally binding agreement between you and Natty Platforms LLC ("Company", "we", "us", or "our"), governing your access to and use of the Adventours platform, including our website at www.playadventours.com, our mobile applications for iOS and Android (collectively, the "Services").
BY ACCESSING OR USING THE SERVICES, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS OR USE THE SERVICES.
You must be at least 13 years of age to use the Services. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.
1. OUR SERVICES
Adventours is a location-based interactive tour platform that allows:
- Tour Creators — individuals and organizations who design, publish, and manage location-based tours through our web dashboard.
- Tour Players — individuals who discover and participate in tours by physically navigating to GPS-tagged locations and completing challenges (quizzes, QR scans, photo tasks, check-ins).
The information provided through the Services is not intended to constitute legal, financial, or professional advice of any kind. We make no guarantees regarding the accuracy, completeness, or suitability of any tour content created by third-party Tour Creators.
2. INTELLECTUAL PROPERTY RIGHTS
Our Intellectual Property
The Services, including all software, design, graphics, text, logos, and source code, are owned by Natty Platforms LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our express written permission.
Your Content
You retain ownership of any tours, questions, images, and other content you create or upload to the Services ("User Content"). By submitting User Content, you grant Natty Platforms LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and distribute that content solely for the purpose of operating and improving the Services.
You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe any third-party intellectual property or privacy rights; and (c) your User Content complies with these Terms and all applicable laws.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
- All registration information you submit is accurate, current, and complete.
- You will maintain the accuracy of such information and promptly update it as necessary.
- You have the legal capacity to agree to these Terms.
- You are not a minor in your jurisdiction, or if you are, you have obtained parental or guardian consent.
- You will not access the Services through automated or non-human means, including bots or scripts.
- You will not use the Services for any unlawful or unauthorised purpose.
4. USER REGISTRATION
To access certain features of the Services, you may be required to register for an account. Tour Creators register via the web dashboard using a magic link sent to your email address. Tour Players may sign in using Google Sign-In or Apple Sign-In on the mobile application.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@nattyplatforms.com of any unauthorised use of your account. We are not liable for any loss arising from your failure to safeguard your account.
We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that it is inappropriate, obscene, or otherwise objectionable.
5. TOUR CREATION AND PUBLICATION
Tour Creators may design and publish location-based tours through the Adventours web dashboard. By publishing a tour, you agree that:
- All tour content, including location data, questions, and media, complies with these Terms and all applicable laws.
- You have obtained all necessary permissions to direct participants to the physical locations included in your tour.
- Your tour does not endanger the safety of participants or bystanders.
- You are solely responsible for the accuracy and safety of your tour content.
We reserve the right to remove or unpublish any tour that violates these Terms or that we determine, in our sole discretion, is harmful, misleading, or inappropriate.
6. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to:
- Create tours that direct participants to trespass, enter restricted areas, or engage in dangerous activities.
- Upload or transmit viruses, malicious code, or other harmful material.
- Attempt to gain unauthorised access to any portion of the Services or any related systems.
- Scrape, crawl, or spider any part of the Services without our express written permission.
- Use the Services to transmit spam, chain letters, or other unsolicited communications.
- Harass, abuse, or harm another person through the Services.
- Create or publish content that is defamatory, obscene, discriminatory, or that infringes any third-party intellectual property rights.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the Services to collect or store personal data about other users without their consent.
- Interfere with or disrupt the integrity or performance of the Services.
7. LOCATION DATA AND SAFETY
The Adventours mobile application uses your device's GPS location to facilitate tour participation. By granting location permissions, you consent to the collection and use of your precise location data as described in our Privacy Policy.
Safety Notice: When participating in location-based tours, you are responsible for your own safety. Always be aware of your surroundings, obey traffic laws, and do not use the Services while driving or operating machinery. Natty Platforms LLC is not liable for any injury, loss, or damage arising from your participation in a tour or your physical presence at any location.
8. MOBILE APPLICATION LICENSE
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Adventours mobile application on a device that you own or control, solely for your personal, non-commercial use.
Apple App Store Additional Terms
If you download the application from the Apple App Store, the following applies: (a) the licence granted is limited to use on Apple-branded products; (b) Apple has no obligation to provide maintenance or support for the application; (c) Apple is not responsible for any product liability claims; (d) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. THIRD-PARTY SERVICES AND CONTENT
The Services may contain links to third-party websites or integrate third-party services (including Google Maps, Apple Maps, Google Sign-In, and Apple Sign-In). We do not control and are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms of service and privacy policies.
Tour content is created by independent Tour Creators. We do not endorse, verify, or take responsibility for any third-party tour content. If you encounter tour content that you believe violates these Terms, please contact us at info@nattyplatforms.com.
10. PRIVACY POLICY
We care about your privacy. Please review our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection and use of your information as described in the Privacy Policy.
11. TERM AND TERMINATION
These Terms remain in full force while you use the Services. We reserve the right to suspend or terminate your account and access to the Services, at our sole discretion, without notice or liability, for any reason — including if we believe you have violated these Terms or applicable law.
You may terminate your account at any time by contacting us at info@nattyplatforms.com. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.
12. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NATTY PLATFORMS LLC DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY TOUR CONTENT CREATED BY THIRD-PARTY TOUR CREATORS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
12. OBJECTIONABLE CONTENT AND USER CONDUCT
Adventours has zero tolerance for objectionable content and abusive behavior. By using this app, you agree that you will not submit, post, upload, or transmit content that:
- Harasses, threatens, bullies, or intimidates any other user
- Promotes hatred, discrimination, or violence against any group or individual based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
- Contains sexually explicit material, graphic violence, or gore
- Spreads misinformation, disinformation, or fraudulent claims
- Infringes on the intellectual property, privacy, or publicity rights of any person
You agree to treat other users with respect. We reserve the right to remove any content and terminate any account, including guest accounts, that violates these rules, without prior notice and without refund. Reports of objectionable content or abusive users are reviewed and acted upon within 24 hours.
You may report objectionable content or abusive users from within the app by tapping a user on the leaderboard and selecting Report. Reports are reviewed by our moderation team.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NATTY PLATFORMS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).
14. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Natty Platforms LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
15. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws applicable to Natty Platforms LLC, without regard to conflict of law principles. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of a recognised arbitration body, unless you opt out in writing within 30 days of first accepting these Terms by emailing info@nattyplatforms.com.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
16. MODIFICATIONS TO TERMS
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by sending a notice to your registered email address. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
